1. Acceptance of Terms
By downloading, installing, or using the GymJam mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.
2. Description of Service
GymJam is a fitness application that provides workout tracking, AI-powered coaching, training plan generation, and a social community for fitness enthusiasts. The App is available on iOS devices.
3. Account Registration
To use GymJam, you must create an account using Apple Sign-In or Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You must be at least 17 years old to use the App.
4. Subscriptions and Payments
Free Tier: GymJam offers limited free access, including up to 20 AI coach messages and basic workout tracking.
Premium Subscription: Premium features include unlimited AI coaching, custom exercises, supersets, and AI training plan generation. Premium is available as:
- Monthly subscription
- 3-Month subscription
- Annual subscription
Billing: Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
Cancellation: You can manage or cancel your subscription at any time through your device's Settings > Apple ID > Subscriptions. Cancellation takes effect at the end of the current billing period.
Free Trial: If offered, any unused portion of a free trial will be forfeited when you purchase a subscription.
5. User Content
You retain ownership of content you post to the GymJam community (posts, comments, photos). By posting content, you grant GymJam a non-exclusive, royalty-free license to display, distribute, and use your content within the App.
You agree not to post content that:
- Is illegal, harmful, threatening, abusive, or harassing
- Infringes on intellectual property rights of others
- Contains spam, advertising, or promotional material
- Is sexually explicit or promotes violence
- Impersonates another person or entity
We reserve the right to remove content that violates these Terms and to suspend or terminate accounts of repeat offenders.
6. AI Features Disclaimer
GymJam's AI coach and training plan features are for informational and motivational purposes only. They do not constitute medical, health, or fitness advice from a certified professional. Always consult a qualified healthcare provider or certified personal trainer before starting any new exercise program, especially if you have pre-existing health conditions or injuries.
AI-generated recommendations may not be suitable for all individuals. You use AI features at your own risk.
7. Health and Safety
You acknowledge that physical exercise involves inherent risks of injury. You are solely responsible for your physical condition and for ensuring that any exercises you perform are appropriate for your fitness level. GymJam is not liable for any injuries sustained during workouts.
8. Intellectual Property
The GymJam app, including its design, features, code, and branding, is the property of GymJam and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App.
9. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's operation
- Use automated tools to scrape or collect data from the App
- Create multiple accounts to circumvent restrictions
10. Termination
We may suspend or terminate your account at any time for violation of these Terms, without prior notice. Upon termination, your right to use the App ceases immediately.
11. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or free of harmful components.
12. Limitation of Liability
To the maximum extent permitted by law, GymJam shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to physical injury, data loss, or loss of profits.
13. Changes to Terms
We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms.
